For the second and hopefully final time, Ashley Martson filed to divorce Jay Smith.
We know so much more about their relationship than we did when Jay’s latest cheating scandal first broke.
We’ve even seen Ashley identify the alleged homewrecker.
But Jay is speaking up and insisting that Ashley isn’t just wrong, but lying.
He claims that he never cheated on Ashley with this woman … but doesn’t exactly deny banging her.

Jay totally blew it!
On April 15, Ashley took to Instagram to apparently accuse Jay of cheating on her (again). At the very least, she mocked him over an upcoming deportation and implied that he was just mooching off of her. Remember that date, as it’s important to Jay’s denial.
Later, she made it clear
Jay had cheated on her, but it sounds like that was just the tip of the iceberg. Ashley predicted that fans will be “shocked” when they learn the whole truth
There was even a rumor that he did more than cheat
Did he knock up his side piece? Jay said that he did not, that he’s not a “little boy” who would be “that stupid.” But a woman claiming to be his mistress said on social media that she’s expecting his child and will give birth in October.
Ashley doubled down on her accusation
Even within her official divorce documents, Ashley accuses Jay of adultery, as seen here on Page 5 of her filing.
And then there’s the deportation
We know that ICE visited Jay in February of 2019, and that he has a deportation hearing scheduled for May 8. So that part is very real.
Ashley says that it’s not her doing
“The reason why he would be deported is for what he chose to do,” Ashley revealed cryptically in an interview last week. In other words, she’s saying that it’s not something that she tried to make happen out of a desire for revenge.
However …
You know how he has a hearing on May 8? Ashley is looking to hire a male model on that day. We cannot stop cackling at the idea of her walking into court with a ludicrously attractive +1 to sit in the gallery. We don’t know if that’s her intention, but it’s a great image.
Ashley also exposed the alleged mistress
Ashley took to Instagram and called out a woman whom she says was Jay’s side piece during their marriage, located after the woman reached out to her about boning Jay.
Ashley’s caption was intense
While we do agree with fans who cautioned Ashley that this woman may have been told ANYTHING about Jay and is not to blame for Jay’s cheating, it’s terrible that Jay put her through this and we understand why she was so upset. Ashley did delete the post a short time after she uploaded it.
Ashley provided just a hint of context
In a recent interview, Ashley said that Jay had been cheating on her for months. Oh dear. …
But Jay says that it’s all a load of BS
“That’s a total lie right there,” Jay tells In Touch Weekly.
He says that the timeline doesn’t fit
“I started talking to her on April 10,” Jay says of the specific woman whom Ashley very briefly accused on Instagram. Notably, that is 5 days prior to Ashley’s Instagram post exposing Jay.
Jay says that his marriage was already over
“And when I started talking to her,” Jay insists. “Ashley and I were broken up already.”
That changes things
He’s not technically claiming to have not cheated, but he is insisting that he didn’t cheat with this particular woman.
What does that mean?
Well, it may mean that he cheated with someone ELSE for months, and Ashley didn’t realize how many women were involved. It could mean that he’s lying to save face with the woman whom Ashley accused.
it could even be worse than that
It may mean that Jay and Ashley initially split for reasons unrelated to cheating at all. A surprise, to be sure, but that would explain her prediction that people “will be shocked.” And we know from 90 Day Fiance previews that the police visit their home at one point. This could end up being much more serious than extramarital banging.
Of course, cheating is the easy explanation
After all, Jay has cheated before. Possibly before their wedding and certainly right after it.
Ashley was understandably unhappy
Jay downloaded Tinder shortly after their Vegas wedding, chatted up girls, and was video chatting with a girl and making plans to meet in person when Ashley caught him. The girl in question had no idea that the dreamy Jamaican 20-year-old with whom she was speaking was a married man.
But Ashley decided to work things out with him
It looks like they had a lot of tense fallout from his cheating, but also some good times in the months that followed.
Then …
90 Day Fiance previews show Ashley being warned about Jay. It’s not clear what it’s about, but many fans assume that it was about him allegedly cheating or at least flirting again.
We still don’t know the whole story
Ashley is keeping a lid on most details until it all plays out on 90 Day Fiance. Frustrating? Sure. But also extremely fair.
